2. Scope of These Terms

These Terms & Conditions apply to all orders placed through our online shop at www.odduniverse.xyz and to all purchases of products offered by Odd Universe GmbH.

These Terms apply to both consumers and business customers, unless a provision expressly states otherwise.

A “consumer” is any natural person who enters into a transaction for purposes that are predominantly outside their trade, business, craft, or profession.

A “business customer” is any natural or legal person who enters into a transaction for purposes relating to their trade, business, craft, or profession.

If mandatory consumer protection laws apply, nothing in these Terms limits or excludes those statutory rights.

3. Products

Odd Universe designs and sells furniture, interior objects, clothing, and related products.

We make reasonable efforts to present our products accurately on the website. However, slight differences in colour, surface, texture, material appearance, dimensions, or finish may occur due to screen settings, lighting, production processes, or the nature of the materials used.

Product images, descriptions, specifications, and availability may be updated from time to time.

4. Orders and Contract Formation

Products can be ordered through our online shop.

By placing an order, you submit a binding offer to purchase the selected products. After placing an order, you will receive an order confirmation or receipt by email.

A contract is concluded when we accept your order, either by sending an order confirmation, dispatch confirmation, or by shipping the products.

We may refuse or cancel an order if a product is unavailable, if there is an obvious pricing or product information error, if payment is not received, or if we cannot fulfil the order for legal, technical, or logistical reasons.

If we cancel an order after payment has already been made, we will refund the amount paid.

5. Prices and Payment

All prices are shown in the currency displayed in the online shop and include statutory VAT where applicable, unless stated otherwise.

Shipping costs, taxes, duties, customs charges, or other fees may apply depending on the delivery destination and will be shown during checkout where applicable.

Payment must be made using the payment methods offered during checkout.

For business customers, additional payment terms may be agreed separately in writing.

6. Shipping and Returns

Shipping, delivery times, return shipping, refunds, and withdrawal instructions are set out in our separate Shipping & Returns policy.

For consumers, the statutory right of withdrawal remains unaffected by any voluntary return policy.

7. Statutory Right of Withdrawal for Consumers

Consumers who purchase products online generally have a statutory right to withdraw from the contract within 14 days without giving any reason.

Details on how to exercise this right, return the products, and receive a refund are provided in our Shipping & Returns policy.

Consumers may use the model withdrawal form below, but this is not mandatory.

9. Statutory Warranty Rights

Consumers have statutory warranty rights under applicable Austrian and EU consumer law.

For movable goods, the statutory warranty period is generally two years from delivery.

If a product is defective, consumers may be entitled to statutory remedies such as repair, replacement, price reduction, or contract termination, depending on the circumstances and applicable law.

Nothing in these Terms limits or excludes mandatory statutory warranty rights.

Customers are asked to inspect products after delivery and contact us at shop@odduniverse.xyz if a product appears damaged, defective, incomplete, or incorrect. This helps us resolve issues quickly. However, this request does not limit any statutory warranty rights of consumers.

10. Commercial Guarantees

Unless expressly stated in writing for a specific product, Odd Universe does not provide an additional commercial guarantee beyond the statutory warranty rights.

Any product-specific commercial guarantee, if offered, will be clearly stated on the relevant product page or in the product documentation, including its duration, scope, conditions, and the procedure for making a claim.

Statutory warranty rights remain unaffected by any commercial guarantee.

11. Product Safety / GPSR

Odd Universe is committed to placing only safe consumer products on the EU market.

Product-specific safety information, including intended use, materials, care instructions, warnings, and relevant product identifiers, is provided on the relevant product page and/or with the product.

Customers should use all products only as intended and follow the care, assembly, maintenance, and safety instructions provided.

Furniture products are intended for normal indoor use unless expressly stated otherwise. They should be placed on suitable, stable surfaces and used only in accordance with their intended function.

Clothing products should be used and cared for according to the care label and product information provided.

If you identify a safety issue, defect, accident, injury, or other product-related risk, please contact us immediately at shop@odduniverse.xyz and include the product name, order number if available, photos where relevant, and a description of the issue.

12. Intellectual Property

All designs, product names, images, texts, graphics, logos, trademarks, website content, and other intellectual property displayed on this website remain the property of Odd Universe GmbH or the respective rights holders.

Purchasing a product does not grant any licence or right to copy, reproduce, manufacture, distribute, or commercially use any Odd Universe design, product, image, text, or other protected content.

13. Limitation of Liability

Nothing in these Terms limits or excludes liability for intent, gross negligence, personal injury, mandatory statutory warranty rights, product liability, or any other liability that cannot legally be limited or excluded.

For business customers, Odd Universe is not liable for indirect damages, loss of profit, loss of business, or consequential damages, except in cases of intent, gross negligence, or mandatory statutory liability.

For consumers, liability is limited only to the extent permitted by applicable mandatory consumer protection law.

14. Force Majeure

Odd Universe is not liable for delays or failures caused by events outside our reasonable control, including but not limited to natural disasters, pandemics, strikes, transport disruptions, supply chain disruptions, governmental measures, technical failures, or other unforeseeable events.

Mandatory consumer rights remain unaffected.

15. Governing Law and Jurisdiction

These Terms are governed by Austrian law, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law applies only to the extent that it does not deprive them of mandatory consumer protection rights under the law of the country in which they have their habitual residence.

For business customers, the competent court in Vienna, Austria, shall have jurisdiction, unless mandatory law provides otherwise.

For consumers, statutory places of jurisdiction remain unaffected.

16. Changes to These Terms

We may update these Terms from time to time to reflect legal, operational, or business changes.

The version available on our website at the time of the order applies to that order.
